Terms of Service and Use (ToS)

1. Acceptance of Terms
By accessing and using the services provided by Bulkmessages.online (referred to herein as “the Service,” “we,” “us,” or “our”), including Bulk SMS and Bulk WhatsApp messaging, agree to be bound by these Terms of Service (ToS). If you do not agree to these terms, you may not use the Service.
2. Service Description
The Service provides a platform for sending large volumes of text messages (SMS) and media-rich messages (WhatsApp) to recipient lists uploaded by the User. The Company facilitates the delivery of these messages but is not responsible for the content of the messages or the legality of the recipient list.
3. User Account and Registration
Eligibility: You must be at least 18 years old to use the Service.
Accuracy: You agree to provide true, accurate, current, and complete information during the registration process and to maintain and promptly update this information.
Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
4. Acceptable Use Policy (AUP)
You agree not to use the Service to send content or messages that:
Spam: Are unsolicited, commercial, bulk, or high-volume messages sent without the recipient’s prior express written consent (opt-in).
Illegal Content: Violate any local, state, national, or international law, including laws governing electronic communication, privacy, and data protection.
Harmful Content: Are harassing, threatening, defamatory, libelous, abusive, vulgar, obscene, racially or ethnically objectionable, or promote illegal activities.
Fraud/Misrepresentation: Involve deceptive marketing practices, phishing, or the transmission of materials that infringe upon the intellectual property rights of others.
Financial Scams: Include messages related to loan scams, unauthorized financial schemes, or pyramid schemes.
The Company reserves the right to immediately suspend or terminate your account and forfeit any unused credit if you violate this AUP.
5. Third-Party Platform Compliance (WhatsApp/SMS)
You acknowledge and agree that the messaging service is dependent on third-party platforms (e.g., WhatsApp, mobile network operators).
WhatsApp Compliance: You are solely responsible for ensuring that all WhatsApp messaging campaigns strictly adhere to the latest WhatsApp Business Policy and Commerce Policy. This includes, but is not limited to, respecting opt-in requirements and avoiding excessive or promotional communication outside of approved templates or customer service windows.
Recipient Consent: You must maintain verifiable proof of opt-in consent from all recipients on your contact lists. Upon request, you must provide this evidence to the Company.
Liability: You agree that the Company is not liable for any penalties, restrictions, or account bans imposed by WhatsApp or network operators due to your use of the Service.
6. Payment, Credits, and Refunds
Payment: All fees for Services, credits, and subscriptions are clearly outlined on the website. Payments are due upon purchase.
Credits: Purchased messaging credits are valid for a specific period (e.g., 6 months or 1 year) as stated at the time of purchase. Expired credits will be forfeited.
Refunds: All refunds are subject to the separate Refund Policy published on the website.
7. Intellectual Property
All content, features, and functionality of the Service, including software, design, text, and graphics, are the exclusive property of Bulkmessages.online and are protected by intellectual property laws.
8. Disclaimer of Warranties
The Service is provided on an “as is” and “as available” basis. The Company makes no warranties, expressed or implied, regarding the reliability, timeliness, completeness, or performance of the Service, including specific delivery rates or avoidance of account bans by third-party platforms.
9. Limitation of Liability
The Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service or your inability to use the Service. In no event shall the Company’s total liability exceed the amount you paid to the Company for the specific services giving rise to the claim during the six (6) months preceding the claim.
10. Termination
We may terminate or suspend your account immediately, without prior notice or liability, if you breach the ToS, especially the AUP or WhatsApp Compliance clauses. Upon termination, your right to use the Service will immediately cease.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of INDIA, without regard to its conflict of law provisions.
